La presente Tesis tiene como objetivo principal determinar cuales son los factores que influyen en la existencia de una jubilacion justa para los musicos, comparando la legislacion aplicada en el Ecuador con las propuestas implementadas en Argentina, Canada y Paraguay. El analisis de los mencionados factores en conjuncion con la teoria del Public Choice determinaron las opciones que tiene una propuesta de jubilacion de los musicos de convertirse en ley publica. El retiro de los artistas se ha considerado un tema polemico dentro de las sociedades; dentro de las artes, la musica es la actividad mas vulnerable de copia y reproduccion, esta violacion de derechos de autor se hace posible a traves del uso de la tecnologia misma que como se determino en este analisis, causa dificultades economicas a los musicos quienes han perdido el interes de grabar sus canciones por sus altos costos y facilidad de reproduccion ilegal.
