Abstract
Lorsqu’une personne doit recourir au système judiciaire pour obtenir justice, il lui faut se montrer diligente, car le temps est son ennemi. La législation de la plupart des États fixe des délais, ceux-ci variant selon la nature de l’injustice subie et le remède demandé. Leur non-respect par le justiciable éteint son droit de recourir aux tribunaux : dans les pays de tradition de droit civil, il s’agit de la prescription extinctive. En apparence injuste, celle-ci est pourtant jugée fondamentale dans tout système de droit. Conséquemment, la présente étude a un triple objet : mettre en évidence les causes véritables et les circonstances réelles de la naissance de la prescription extinctive des droits personnels, préciser ses fondements et suivre l’évolution de cette notion, de sa conception jusqu’à aujourd’hui.
