Abstract
À partir de l’affaire Al Bashir devant la Cour pénale internationale, l’auteur analyse les formes de responsabilité employées en droit international pénal pour répondre au caractère collectif de la commission des crimes de guerre, crimes contre l’humanité et génocide. La stratégie des poursuites de la Cour vise les principaux responsables de tels crimes. L’auteur se demande dans quelle mesure le choix de les inculper en vertu de la responsabilité du fait d’un intermédiaire répond aux critiques formulées contre une autre forme de responsabilité pénale proche, à savoir l’entreprise criminelle commune développée par les juridictions ad hoc des Nations Unies.
