Abstract

Cet article se saisit du problème de la gestion sur la durée de la menace terroriste par un organe dédié aux mesures ponctuelles aux fins du maintien et du rétablissement de la paix et de la sécurité internationales. L’auteur y évalue la gestion de la lutte contre le terrorisme par le Conseil de sécurité à l’occasion du dixième anniversaire des attentats du 11 septembre 2001. Sous l’angle du droit international et, plus spécifiquement, du droit institutionnel des Nations Unies, le bilan de la lutte antiterroriste menée par le Conseil de sécurité est très riche. Aussi bien en raison du foisonnement des organes mis en place et de leur restructuration incessante que de la définition recommencée de leurs missions et du passage d’une approche criminologique à une approche sociologique. Le but étant de corriger les mesures initiales et de les adapter à l’évolution du terrorisme international. Cette activité débordante ne permet cependant pas encore de conformer complètement les mesures du Conseil au droit international – les mesures adoptées à ce titre étant à certains égards plus symboliques que réelles – ni de conduire la lutte antiterroriste du Conseil dans un cadre institutionnel parfaitement coordonné. Ces limites empêchent le Conseil d’atteindre son efficacité optimale dans cette lutte. Mais si l’unification des structures de la lutte antiterroriste du Conseil est clairement envisageable, la question de la compatibilité entre cette lutte et le respect du droit international demeure, du fait du pragmatisme qui caractérise la lutte antiterroriste menée par le Conseil.
