Abstract
Même si le nombre de séparations et de divorces est plutôt stable depuis quelques années, la structure des familles post-séparation continue à se diversifier. La séparation est une période critique pour les membres de la famille qui peut comporter des défis, notamment sur le plan de la résolution des conflits et du maintien des relations. À cet effet, il existe plusieurs services destinés aux parents qui se séparent, dont la médiation familiale. Parce que les besoins de l’enfant sont au cœur du processus de médiation familiale, des acteurs s’interrogent sur la place réelle qu’on doit lui accorder dans ce processus. L’inclusion de l’enfant dans la médiation familiale est appelée à se développer dans les prochaines années si l’on conjugue évolution du statut de l’enfant dans la société et dans les législations et réalité du vécu des parents séparés en conflits. Mais les médiateurs familiaux sont-ils prêts à investir cette nouvelle forme de pratique ? Quels sont les avantages et enjeux de cette pratique ?
