Abstract
La Convention des Nations unies sur le droit de la mer (CNUDM) octroie aux Etats cotiers de nombreux droits et responsabilites dans les eaux adjacentes a leur territoire. Pour assurer le respect de ces normes, un droit de poursuite a ete prevu. Ce droit de poursuite, datant de plusieurs centaines d’annees, a ete integre dans la convention en fonction des technologies de l’epoque. Cependant, parmi les criteres qui encadrent ce droit, on y retrouve deux obligations problematiques : l’obligation de signaler le debut de la poursuite et l’obligation du caractere continu de la poursuite. De plus, les dispositions relatives a ces obligations sont redigees de telle sorte qu’integrer l’usage de nouvelles technologies est presque impossible. Donc, la pertinence de ce droit de poursuite depend de sa capacite d’adaptation. C’est pourquoi une interpretation large ou une modification des dispositions pertinentes de la CNUDM est necessaire.
