Abstract
Does Chapter 11 of NAFTA have an impact on the state’s authority to enact measures to protect the environment and public health? In 1998, the Government of Canada settled a lawsuit with Ethyl Corporation, an American company, and repealed the challenged legislative provisions. Many analysts do not find this problematic, as they believe that the legislation in question was not really aimed at protecting the environment and public safety, but instead was protectionist. However, recent public health studies are now casting new light on this issue.
