Abstract
Le présent article porte sur les dynamiques existantes entre les trois grands types d’intervenants dans la « lutte contre l’argent sale », à savoir les instances non étatiques sommées de dénoncer les opérations financières suspectes, l’instance administrative spécialisée dans le traitement et le renvoi de ces dénonciations et enfin les instances pénales autorisées à utiliser celles qui leur parviennent à des fins de poursuite judiciaire. Pour ce faire, la démonstration repose sur un accès inédit aux données concernant les dénonciations pour soupçon de blanchiment d’argent en Suisse qui, confrontées aux statistiques de condamnations pénales en la matière, font apparaître des écarts permettant d’envisager la mesure de la délinquance financière comme une exploration de la tension constante entre illégalisme et délinquance. À cet égard, il ressort du contexte suisse que certaines situations dénoncées résistent beaucoup mieux que d’autres à l’application d’une qualification d’infraction pénale en matière de blanchiment d’argent et, par extension, à l’objectivation en tant que figure de délinquance.
