Abstract
The Canadian courts formerly described freedom of conscience and religion under section 2(a) of the Canadian Charter of Rights and Freedoms as the liberty to hold, and live in accordance with, spiritual and other fundamental beliefs without state interference. This chapter focuses on another dimension of religious freedom: the insulation of religious practice from state restriction. The courts do not engage in any real balancing of competing claims (the state&s;s policy versus the individual&s;s religious practice) and have required the state to accommodate a religious practice only when the practice does not directly conflict with civic interests. The difficulty in enforcing state neutrality towards religion is apparent in the Canadian courts&s; section 2(a) judgments dealing with both state support for religious practice and state restriction on such practice. The court must decide whether a religious individual or group should be exempted from a particular public norm and permitted to live in accordance with their different normative view.
