Abstract
En lo que sigue, vamos a analizar los problemas relativos a las personas juridicas y el dano moral. Asi, cuando una persona juridica como “sujeto de derecho” sufre un dano, sea patrimonial o extrapatrimonial, tiene derecho a reclamar una indemnizacion al responsable. Con mayor frecuencia, resulta en un dano economico, facilmente detectable en una sociedad o entidad determinada. Sin embargo, uno se pregunta si las personas juridicas, como personas sin existencia fisica, pueden sufrir un dano moral. En efecto, sabemos que “una persona juridica no es una persona fisica, humana; no sufre, no ama, no es de carne ni hueso, es simplemente un ser artificial”. En consecuencia, resulta imperioso saber si estas entidades juridicas pueden sufrir un dano moral y reclamar la indemnizacion correspondiente. En relacion, si bien la jurisprudencia francesa ha de reconocerles tal derecho desde hace tiempo, al igual que lo ha hecho el Tribunal Europeo de Derechos Humanos (TEDH), la doctrina aun se encuentra dividida, debatiendo si la persona juridica puede accionar por dano moral.
