Abstract
In this chapter, the application of the evaluative framework for proceduralization to the Montreal compliance system shows that administrative procedures can play a positive role in promoting procedural regard for the interests of affected states. The first part of the chapter analyzes the implications of adopting administrative procedures for accountability, transparency, participation, reason giving and review. This thematic analysis is crystallized by a vignette of the non-compliance proceedings involving the Russian Federation, which demonstrates the extension of procedural regard to a country in transition.
