Abstract
En France, la réforme du divorce entrée en vigueur le 1er janvier 2017 signe une évolution d’envergure, en contractualisant le divorce par consentement mutuel ; elle s’inscrit dans un mouvement plus large de contractualisation de la séparation et de ses conséquences, y compris en matière d’exercice de l’autorité parentale. La Loi no 2016-1547 du 18 nov. 2016 de modernisation de la justice du XXI e siècle semble répondre à des aspirations contemporaines pressantes : autodétermination et individualisation, pacification des relations, rapidité et économie. Pour autant, le bilan provisoire se révèle extrêmement mitigé. Non seulement parce que ces aspirations pourraient bien être en partie déçues, notamment au regard du besoin de protection des justiciables, mais aussi parce que la voie empruntée, soit une contractualisation exclusive et quelque peu précipitée, risque d’entraîner de nouvelles difficultés, en particulier dans l’espace international.
