Abstract
En sortant d’une approche positiviste et en abordant le droit international public sous un angle critique, l’usage prend le pas sur le cadre. Au Moyen-Orient, le droit apparaît comme un outil ambigu au service de diverses stratégies et mobilisé par divers acteurs. À travers des exemples précis (la question palestinienne; la politique israélienne; le Liban; les conflits libyen et syrien; la politique russe dans la région), nous nous rendons compte que le droit international est avant tout une langue. Du moins, il est possible d’affirmer qu’il n’est jamais ce qu’il prétend être. Une désacralisation du droit devient alors nécessaire, salutaire. Il ne s’agit cependant pas ici d’une désacralisation nihiliste, mais d’un travail serein de déconstruction qui conserve une certaine place à la notion de souveraineté. Nous pouvons ainsi affirmer que notre approche est une approche réaliste-critique. Critique sur les utilisations contemporaines du droit international et réaliste quant à l’importance du cadre stato-national, et donc de la souveraineté, objet de notre conclusion.
