Abstract
La Commission européenne encourage les États membres à mettre en place des actions collectives et a récemment formulé une proposition de directive dans le domaine de la protection des intérêts collectifs des consommateurs. L’efficacité de ces mécanismes d’action collective dépendra de leur financement. Cet article porte sur le financement privé des actions de groupe par un tiers financeur. Il examine les pratiques pertinentes en Australie, au Canada et aux États-Unis, et analyse la position du droit européen afin de mieux comprendre les enjeux de ce financement et son possible encadrement.
