L’article 6(5) PAII : quelle pertinence à l’ère du contre-terrorisme?

Abstract
Le récent accord de paix conclu le 24 novembre 2016 entre les Forces armées révolutionnaires de Colombie (FARC) et le gouvernement colombien, qui prévoit une amnistie notamment pour la rébellion et le port illégal d’armes, peut paraître étonnant, voire choquant, après une lutte armée de plus de 50 ans qui a entraîné des centaines de milliers de morts et des dizaines de milliers de disparitions. Pourtant, ce compromis est conforme aux prescriptions du droit international humanitaire, en particulier à la lettre de l’article 6 paragraphe 5 du Protocole additionnel II aux Conventions de Genève de 1949. La présente contribution vise à examiner les raisons d’être de l’article 6(5) PAII, et à déterminer si elles sont toujours pertinentes dans le cadre juridique international. Elle se penche à terme sur sa compatibilité avec les préoccupations actuelles, a priori contradictoires, en matière de lutte contre le terrorisme.
