L’observation des règles appliquées dans une société de transport routier entre les années mille neuf cent quatre-vingt et aujourd’hui fait apparaître une transformation notable du rapport au droit entretenu par l’entreprise en matière de relations du travail. D’abord dominé par un refus de la législation d’origine étatique et la prééminence de règles professionnelles coutumières, ce rapport évolue vers une prise en compte de la loi. Cependant, plutôt qu’une attitude simplement légaliste, il apparaît que l’entreprise mobilise la législation tel un relais ou comme un objectif, tandis que s’interpose un droit interne à l’entreprise. En fonction des circonstances, ces règles prennent des formes très variées, bien que leur contenu ne change pas de façon systématique. C’est ainsi que s’entremêlent accords d’entreprise, engagements unilatéraux et arrangements informels. Cependant, par l’autonomie qu’acquièrent ces règles par rapport à la loi et l’application volontaire dont elles font l’objet, elles renvoient à une mise en œuvre coutumière de la règle.
