Les réorganisations d’entreprises sont devenues un phénomène assez courant. Une réorganisation suspend le droit des créanciers et prolonge le mandat des dirigeants. Elle entraîne en outre une réduction des dettes non prioritaires de l’entreprise dans une proportion de 90 % ou plus. Ces dettes représentent la principale source de financement externe pour bon nombre de PME. La loi sur la faillite et l’insolvabilité est l’une des deux principales lois canadiennes permettant les réorganisations. Elle instaure un processus de sélection, sous la responsabilité des syndics, déterminant quelles entreprises en difficulté sont admises à une procédure de réorganisation. L’article présente une évaluation de ce processus. À la différence d’autres recherches axées sur les résultats obtenus en termes de survie des entreprises sélectionnées, la recherche évalue son efficacité informationnelle. Cette recherche, inspirée de la théorie financière, analyse de façon minutieuse l’utilisation de la procédure de réorganisation par 3 916 entreprises en lien avec les données financières disponibles au moment de la sélection.
