Abstract
En dépit de son titre, le Testament de Philippe Fortin de La Hoguette ne paraît pas testamentaire, surtout comparé à la tradition littéraire, ironique et polémique, incarnée par François Villon. Pour rendre compte d’un tel texte, il faut momentanément abandonner le modèle notarial de la tradition satirique pour se tourner vers l’étymologie : celle du testis, qui fait du testateur un témoin, et celle de la testatio mentis, qui fait du testament un témoignage de l’esprit. Ce détour permet de constater d’une part l’avantage rhétorique de la posture testamentaire – où l’on ne peut mentir, et où, pour cette raison, le témoignage ne peut être contesté –, et d’autre part la liberté intrinsèque de cette forme d’écriture, dans laquelle le message du testateur devient un bien à part entière.
