Abstract
Resumo Este artigo discute a hipótese de que o imposto sobre circulação de mercadorias e serviços de comunicações (ICMS) se tornou obsoleto, perdendo cada vez mais espaço no sistema tributário brasileiro e, com isso, também aprofundando a crise dos governos estaduais nessa federação. Apesar de ainda ser o imposto que individualmente mais arrecada no país, pesa relativamente cada vez menos na carga tributária global, fora as consequências negativas para equidade social e competitividade das empresas. Mudanças legislativas recentes se voltaram apenas para o passado, de modo a convalidar benefícios da guerra fiscal, mas em nada ajustaram o tributo para o futuro da era digital. Na nova e futura era, em que mercadorias certamente perderão importância para serviços e direitos de imagem, o ICMS se tornará ainda mais ultrapassado e os estados podem serem ainda menos relevantes na federação. Esse cenário não mudará sem a substituição do ICMS por um imposto sobre valor adicionado. Ainda assim, é muito provável que seja preciso reinventar todo o sistema tributário, brasileiro e mundial, para corresponder aos desafios impostos pela nova economia e sociedade.
