Abstract
Les derniers changements législatifs et politiques canadiens en matière d’immigration témoignent de la volonté de l’État de réaffirmer sa souveraineté à l’échelle globale, par la mise en place de contrôles migratoires. Bien que le droit canadien comme le droit international sanctionne le pouvoir souverain dont dispose l’État Nation de contrôler les entrées sur son territoire, l’usage abusif de cette prérogative démontre toutefois l’adhésion plus marquée de l’État aux impératifs des idéologies néolibérale et sécuritaire, à la mode américaine, et contribue à l’érosion des droits des demandeurs d’asile. Néanmoins, trop peu d’entre nous n’osent encore remettre en question leur légitimité.
