Abstract
Dans le cadre de la décennie de l’entrée en vigueur du Statut de Rome , l’auteur revient sur la question de savoir si la CPI se serait engagée dans la voie d’une justice pénale discriminatoire dont seraient « victimes » les Africains. En analysant (i) la manière dont la CPI a été saisie durant sa première décennie d’activité et (ii) l’inaction des tribunaux africains, l’auteur conclut au fait que, dans le choix des situations, la thèse d’une « cour contre les Africains » est peu convaincante. Il fait cependant observer que les deux facteurs précités n’expliquent pas pour autant que, dans le choix des affaires, seuls les Africains soient visés, puisque même en restant dans les situations africaines, l’on peut observer la présence des acteurs non africains intervenant dans les conflits armés qui déchirent l’Afrique; et que de ce fait, rien ne justifie que dans ces situations, les poursuites ne puissent viser que les Africains. Quant aux rapports entre la CPI et les victimes africaines, l’auteur démontre que les réponses jusqu’ici apportées par la CPI au besoin de justice pénale de ces victimes ne confirment que partiellement la thèse d’une « cour attentive à la souffrance des victimes africaines ».
