Comme chacun le sait, il n’y a pas un droit mais des droits : un droit français, un droit belge, un droit québécois, etc. Évidemment, je ne pourrai pas parler ici de chacun des droits nationaux. Je prendrai souvent appui sur le droit français – qui vient naturellement sous ma plume – et, autant qu’il m’a été possible de le connaître, sur le droit applicable au Québec. Toutefois, par delà les différences techniques, il existe un savoir, ou une culture propre aux juristes, d’ici et d’ailleurs ; je pense qu’ils ont quelque chose à nous apprendre sur la douleur.
