Abstract
Dans cet article, l’auteur analyse la décision Côté rendue par la Cour d’appel du Québec. En s’appuyant en outre sur les événements qui ont suivi de peu l’adoption de la Proclamation royale de 1763 et sur la jurisprudence récente, il suggère que le titre ancestral de common law existe toujours au Québec au même titre que dans les autres provinces canadiennes. En se repliant sur les critères élaborés par la Cour suprême en matière de traité, l’auteur conclut que le Traité de Swegatchy n’en est pas un. Finalement, en reprenant le test de justification de l’arrêt Sparrow , il examine la constitutionnalité des règlements contestés.
