Abstract
Le développement du recours au travail par intermédiation numérique s’accompagne de l’essor du travail à la demande, dans un contexte de reconfiguration des rapports de production. Le modèle économique des plateformes numériques, désigné par le terme d’« ubérisation », repose sur le recours à une main-d’oeuvre flexible, disponible, peu coûteuse et supportant les risques de l’activité. Le débat juridique se cristallise alors autour des tentatives de qualification, sur fond de contentieux impliquant les entreprises phares de cette « industrie » : le travailleur du numérique est-il un salarié, un indépendant, un semi-indépendant ? Faut-il créer un statut propre à cette forme d’activité ? L’enjeu de l’adaptation du droit du travail à cette révolution numérique implique alors de considérer la dépendance économique dans laquelle se trouvent les travailleurs de cette économie pour déterminer les voies menant à l’amélioration de leur protection. Cette étude examine ces questions au regard du cadre juridique français.
