Abstract
La mère d’un enfant enregistre parfois seule la naissance de ce dernier. Si le père tente d’échapper à ses obligations, une action en réclamation de paternité sera nécessaire à l’établissement de la filiation et à l’inscription de son nom à l’acte de naissance. Mais il arrive que le père veuille assumer sa paternité; marié à la mère, il peut même en dépit d’une séparation de fait, être considéré par le Code civil comme le père présumé de l’enfant. Le fait que la naissance ait été enregistrée à son insu l’oblige-t-il alors à intenter une action en réclamation d’état ? Ne pourrait-on admettre qu’il puisse procéder par simple requête en rectification ? Ce court article examine cette question à partir d’une décision de 1990 de la Cour d’appel du Québec, Droit de la famille 766. Le principe établi dans cette affaire, suivi par la jurisprudence, repose malheureusement sur un raisonnement critiquable.
