Abstract
La possession d’état est un des plus anciens modes de preuve de la filiation. Aujourd’hui cependant, elle sert surtout à consolider une filiation déjà établie par l’acte de naissance. A-t-elle pour autant perdu sa fonction de preuve autonome de la filiation ? La Cour d’appel du Québec, dans un jugement correct dans son dispositif, mais critiquable dans son raisonnement, semble limiter ce rôle à celui de preuve judiciaire de la filiation. En droit québécois, la possession d’état n’est-elle pas aussi un mode de preuve extrajudiciaire de la filiation ?
