Abstract
Developing family policy bit-by-bit. The normalisation of shared custody in Quebec. In contemporary society there is a declining reliance on the law to determine the normative orientation of family policy. Instead, the law guarantees the management of a process for the joint construction of norms. In some cases, recourse to legal procedures or legislation is even ruled out. This is the case in Quebec with the de facto presumption of shared physical custody, which was gradually established through administrative and professional channels and with the help of certain case law. This article explores the way in which this new norm on family policy is based on an ideal of symmetry in parental custody, which is now presented both as necessary for the child’s well-being and as the foundation for equality between the sexes.
