Abstract
Le patrimoine de la personne constitue le gage commun de ses créanciers. Le législateur québécois a rompu avec la conception classique du patrimoine unique pour instaurer un régime de fiducie permettant la création d’un patrimoine d’affectation sur lequel le constituant peut se nommer cofiduciaire et bénéficiaire à la fois sans toutefois posséder de droits réels sur ces biens. Voilà qui constitue à priori un patrimoine à l’abri des créanciers du constituant, communément appelé « fiducie de protection d’actifs ». Depuis son instauration en 1994, les tribunaux québécois ont fait un constat que ce patrimoine d’affectation en vue de protéger le débiteur de ses créanciers contrevient à des normes axiomatiques du droit civil lesquelles doivent l’emporter sur la validité de pareil patrimoine d’affectation. En effet, les tribunaux n’hésitent pas à déclarer nulles les fiducies de protection d’actifs faites au détriment des créanciers du constituant. C’est ainsi que la fiducie de protection d’actifs n’est qu’un mirage.
