Abstract
Le rôle fondamental joué par l’UE dans l’adoption de la Convention sur la protection et la promotion de la diversité des expressions culturelles de 2005, son engagement actif dans la mise en oeuvre de cet instrument juridique, autant dans son ordre interne que dans ses relations extérieures, témoignent de sa volonté et de celle de ses États membres de protéger la diversité des expressions culturelles menacées par les effets néfastes des règles de libre-échange. Plus particulièrement, dans le domaine du commerce, l’UE a adopté le modèle d’accord le plus novateur auquel est annexé un Protocole de coopération culturelle, permettant de mettre en oeuvre certaines dispositions de cet instrument juridique culturel. En revanche, lors de la conclusion des récents accords commerciaux, l’UE a adopté un comportement beaucoup moins protecteur à l’égard de la diversité des expressions culturelles.
