Las normas de defensa de la competencia utilizan un concepto material de empresa, en el que es indiferente la forma jurídica de la entidad, su naturaleza pública o privada y su modo de financiación. Lo relevante es que lleve a cabo una actividad económica. No se aplican, pues, a las actividades que se organizan en base a criterios de solidaridad. Las autoridades administrativas no pueden tampoco ser sancionadas por prácticas anticompetitivas cuando ejerzan potestades públicas. No obstante, dicha actuación podrá ser anulada por contravenir las normas de defensa de la competencia. No se aplican tampoco a las restricciones amparadas en el derecho de la UE o en leyes estatales, ni a las conductas que sean objeto de regulación sectorial.
