Dans la première partie de ses remarques, l’auteur s’inspire d’une théorie développée en analyse économique du droit pour faire ressortir que l’exécution en nature comme sanction de l’inexécution d’une obligation contractuelle a pour effet de donner au créancier, de préférence au tribunal, la faculté de déterminer lui-même la valeur de l’obligation inexécutée. L’article relate le dénouement de certains différends à l’origine de décisions québécoises récentes sur le sujet pour contrer la supposition que l’émission d’« injonctions mandatoires » en matière contractuelle mène nécessairement à l’exécution forcée de la prestation promise par le débiteur lui-même. Après avoir discuté de la place que peut légitimement revendiquer la common law comme source du droit québécois en la matière, l’article soutient que, dans une large mesure, les frontières de l’exécution en nature des obligations en droit québécois restent encore à tracer. À titre d’illustration, l’auteur se dit d’avis que la règle de l’arrêt Dupré Quarries, qui exclut en principe l’exécution en nature en matière de contrats individuels de travail, devrait être remise en question.
