Abstract
Le nouveau Code civil du Québec prévoit quatre hypothèques légales, soit celle de l’État et des personnes morales de droit public, celle des personnes qui ont participé à la construction ou à la rénovation d’un immeuble, celle du syndicat des copropriétaires et celle des personnes qui ont une créance résultant d’un jugement. Elles proviennent des hypothèques légales ou des privilèges déjà prévus au Code civil du Bas-Canada. Cette étude examine donc les changements apportés par le nouveau Code relativement à ces garanties légales. Elle compare également les nouveaux modes de création et de conservation de ces sûretés avec le régime actuel.
