Abstract
L’exécution, la présence ou l’utilisation non fautives de travaux publics peuvent causer des dommages à un administré. La présente étude décrit le droit du justiciable à l’indemnisation de ces dommages par l’Administration. On ne peut appréhender le droit québécois pertinent sans parcourir préalablement les droits britannique, canadien et français sur le sujet. Le droit public qui régit l’acte de l’Administration et le droit privé de propriété de la victime s’y rencontrent. Le fait que, en cette matière, législateurs et tribunaux aient tous deux flirté avec le droit de l’expropriation, contribue à la confusion des compétences (administrative ou judiciaire) et des droits substantifs (indemnisation de droit statutaire ou action de droit commun privé). Si elle n’est pas source d’obligation en droit québécois, l’équité anime tout de même ici certaines décisions judiciaires.
