Abstract
L’union de fait jouit d’une popularité grandissante auprès des sociétés occidentales et plus particulièrement au Québec. Pourtant, le phénomène ne bénéficie toujours pas d’une protection légale uniforme. Dans ce contexte, les auteures traiteront de la situation de l’union de fait au regard du droit positif et porteront une attention particulière à l’antinomie qui gouverne le droit social et le droit civil actuels. Les voies contractuelles offertes aux concubins pour régler leurs rapports d’ordre patrimonial seront également portées à l’étude, de même que les solutions développées par la jurisprudence en l’absence de contrat, soit la société tacite et l’enrichissement injustifié. Ce dernier point pose plusieurs difficultés en ce que les tribunaux font régulièrement appel à la common law pour corriger les lacunes du droit civil.
