Abstract
Selon la tradition civiliste, l’obligation alimentaire prend fin avec le décès du débiteur. Mais voilà qu’au Québec, depuis le 1er juillet 1989, les créanciers d’aliments peuvent réclamer de la succession de leur débiteur une contribution financière à titre d’aliments. En premier lieu, l’auteur retrace l’évolution très lente qui a amené le législateur à admettre ce recours. Il en analyse ensuite les conditions d’exercice, ainsi que la réduction des libéralités qui en est la conséquence. L’exposé se termine par une appréciation sommaire de cette législation nouvelle.
