Abstract
Le plus important risque commercial pour un exportateur est le risque de non-paiement. Pour minimiser ce risque dans une transaction internationale, l’auteure souligne qu’il faut d’abord l’évaluer en s’informant sur la solvabilité du client-débiteur étranger. Elle précise les sources disponibles pour obtenir ces informations financières dans le contexte international. Le risque de non-paiement évalué, l’auteure explique divers moyens de le gérer. Elle analyse les différentes formes et techniques de paiement qui peuvent être prévues dans un contrat pour que l’exportateur conserve le contrôle et la propriété des marchandises tant qu’il n’a pas été payé. Elle explique également comment par l’intervention de tiers-cautions ou de tiers-assureurs on peut se prémunir contre le risque de non-paiement. Enfin, elle rappelle que le choix entre les divers moyens légaux offerts pour gérer ce risque est une décision commerciale qui doit être prise au cas par cas.
