Abstract
L’octroi de droits privilégiés, souvent occultes, sur les biens d’un débiteur en faveur du fisc n’est pas un phénomène nouveau. Ce texte décrit certains motifs pour lesquels le législateur, à l’occasion de la réforme du Code civil, devrait revoir les principes à la base de ces prérogatives et tendre à soumettre les créances fiscales à un régime de droit, incluant la publicité, similaire à celui imposé aux autres créances. Abolir la priorité fiscale, particulièrement sur les meubles, constituerait un apport non négligeable à l’efficacité du nouveau système de sûretés et reconnaîtrait pleinement l’impact que l’informatique peut et doit avoir en ce domaine.
