Abstract
L’AECG pave la route à un nouveau modèle d’accords commerciaux. Les innovations y sont nombreuses mais la plus importante demeure toutefois la coopération règlementaire. Un chapitre particulier lui est consacré et de nouveaux mécanismes institutionnels ont été introduits, avec l’objectif général de rapprocher les réglementations, d’éliminer les barrières inutiles au commerce et à l’investissement, de privilégier les bonnes pratiques et la transparence et de favoriser leur convergence, y compris par la reconnaissance mutuelle. Alors que les nouvelles technologies bouleversent la production et le commerce, il ne s’agit plus tant aujourd’hui d’ouvrir les marchés que de les interconnecter. L’article replace le débat nouveau qui s’est amorcé autour de la coopération réglementaire dans ce nouveau contexte, montre en quoi la démarche initiée par l’AECG s’écarte des modèles traditionnels aussi bien de négociation commerciale que de coopération intergouvernementale, et revient sur les perspectives offertes par le Forum de coopération en matière de réglementation pour inclure la société civile aux débats.
