Abstract
Les dispositions du Code civil de 1866 régissant la copropriété indivise ne répondent plus aux besoins de la société québécoise qui emprunte de plus en plus ce mode de propriété. Le législateur a constaté la désuétude de ces dispositions du Code civil du Bas-Canada et a adopté, en avril 1987, le Projet de loi 20 qui instaure, entre autres, un cadre législatif propre à la copropriété par indivision. Le but de cette étude consiste à analyser l’ensemble de cette réforme, en faisant le parallèle avec la législation actuelle, afin de définir le nouveau cadre juridique dans lequel évolueront les indivisaires au lendemain de l’entrée en vigueur du Code civil du Québec.
