Abstract
Dans cet article l’auteur expose les idées forces qui étaient contenues dans le Code civil du Bas-Canada lors de son adoption en 1866. Il montre ensuite comment elles ont évolué à l’intérieur du Code civil, mais aussi à l’extérieur de celui-ci par voie de législation spéciale. Il s’interroge alors sur la place et sur le rôle respectif du Code civil et des lois particulières dans un système de droit codifié. Quel doit être à cet égard l’objet d’une codification nouvelle ? Comment l’adapter par la suite aux changements en évitant les cycles de « décodification » et de « recodification ». La réponse semble résider dans la méthode et dans l’effet de la codification elle-même.
