Abstract
En France, en Angleterre et au pays de Galles, les enfants peuvent séjourner auprès de leur mère détenue en prison jusqu’à leurs 18 mois. L’étude des liens familiaux de l’enfant qui séjourne auprès de sa mère en prison inverse la problématique : l’enfant non juridiquement détenu est celui qui vit dans un établissement pénitentiaire auprès de sa mère. Le parent incarcéré constitue, dans cette situation, la personne qui maintient au quotidien des relations affectives avec l’enfant. L’autre parent peut-il, dans ce cadre, exercer ses droits civils et maintenir un lien avec l’enfant résidant en prison ? Les droits français et anglais parviennent-ils à dépasser une conception genrée et hétéronormée de la famille en prison, selon laquelle seule une femme détenue peut garder son enfant auprès d’elle et seul un homme n’est envisagé comme deuxième parent ?
