Abstract
La notion de rétroactivité d’une loi est fort discutée, mais peu comprise, dans la jurisprudence et dans la doctrine. L’ambiguïté sémantique du terme est telle que plusieurs explications doctrinales sont ou bien défectueuses, ou bien carrément inopérationnelles. Dans ce texte, l’auteur propose un modèle d’analyse conceptuelle de la notion de rétroactivité qui est cohérent et pleinement opérationnel. Ce modèle est destiné à servir dans l’élucidation des problèmes jurisprudentiels et doctrinaux provoqués par l’application du principe d’interprétation concernant le jeu de la loi dans le temps. Dans un deuxième temps, l’auteur spécule sur certaines conséquences d’une pleine compréhension de la notion de rétroactivé sur l’interaction de deux composantes (législative et judiciaire) du gouvernement.
