Abstract
Ce texte cherche à cerner l’étendue de la compétence législative provinciale sur la moralité publique. La difficulté vient du fait que la Loi constitutionnelle de 1867 attribue au Parlement fédéral une compétence exclusive en matière de droit criminel. Il s’agit ainsi de voir jusqu’où les provinces et les municipalités peuvent réglementer des sujets tels la prostitution, les revues érotiques, les salons de massage, etc., sans empiéter sur la compétence fédérale.
