Au Québec, c’est en 1979 que la législation sur le recours collectif, largement inspirée des class actions américaines, est officiellement entrée dans nos moeurs juridiques. Il s’agit d’un moyen de procédure permettant à une personne d’agir sans mandat pour le compte d’un groupe de personnes et qui, en théorie du moins, peut être utilisé dans tous les secteurs du droit et pour tous les types de recours. Cette étude qui participe à la fois du droit québécois et du droit américain vise à situer le modèle québécois de recours collectif dans son environnement global. Après avoir décrit la législation américaine qui a servi de modèle aux dispositions québécoises et plus particulièrement les dispositions relatives aux conditions d’autorisation d’exercice du recours, l’auteure examine l’état du droit de chacune des conditions d’autorisation contenues dans la législation québécoise, à la lumière des jugements rendus jusqu’ici soit par la Cour suprême du Canada, soit par la Cour d’appel du Québec.
