Abstract
Le recours à la grève déborde parfois le cadre dans lequel le législateur québécois l’a insérée. Illégale, elle rend ses auteurs passibles de sanctions pénales. Le Tribunal du Travail se voit alors octroyer une juridiction pénale souvent incompatible avec sa vocation de dispenseur de « solutions de relations de travail ». Comme le révèle l’étude détaillée de cette juridiction et de sa mise en oeuvre, l’atténuation des amendes au profit de solutions alternatives appropriées, tel le renvoi à un médiateur ou l’ordonnance de « cease and desist », pourrait rendre plus harmonieuses les relations de travail. L’économie générale du Code du Travail en serait enrichie.
