Abstract
Ce texte trace l’évolution au Québec du régime juridique applicable à la responsabilité extra-contractuelle de la Couronne. Celle-ci a gardé quelques-unes de ses prérogatives. L’article 9 du Code civil et l’article 42 de la Loi d’interprétation en sont la preuve. Par contre, le législateur québécois a permis que la Couronne soit liée par la Charte des droits et libertés de la personne et a institué des régimes visant entre autres à réparer le préjudice subi par des victimes d’accidents ou d’actes criminels. Le législateur québécois cherche de façon générale à équilibrer les intérêts individuels et les intérêts de la collectivité.
