Abstract
La « Loi 89 », qui se veut un élément fondamental de la réforme du Code civil du Québec, risque de plonger cette province dans une querelle constitutionnelle dont elle sortira perdante. Elle empiète en effet carrément sur la compétence législative fédérale sur le mariage et le divorce. Cet empiétement est d’autant plus sérieux que certains juges de la Cour suprême du Canada interprètent étroitement les pouvoirs législatifs dits « incidents » ou « ancillaires » que peuvent posséder les provinces. Enfin ce n’est pas une délégation de pouvoirs fédérale-provinciale qui pourra donner satisfaction au Québec en matière de compétence législative sur le mariage et le divorce. Un amendement constitutionnel devra venir de Londres.
