Abstract
Inspiré par les travaux du professeur J.-Gaston DesCôteaux sur les normes du travail, l’article suivant traite des différents problèmes que soulève l’application d’un type de normes, les normes à caractère économique, telles qu’on les trouve dans deux lois, la Loi sur les normes du travail du Québec et le Code canadien du travail, partie III. Quatre normes principales font l’objet d’une analyse détaillée : le salaire minimum, les heures de travail, les vacances annuelles et les jours fériés ou congés payés. Pour chaque norme, l’article étudie, entre autres, les exclusions et les exceptions, les conditions d’ouverture du droit, la nature de la norme, les modalités d’application et, s’il y a lieu, les cas spéciaux. L’article se termine par de brefs commentaires sur l’impact économique et social de ces normes.
