Abstract
Par delà les modifications expresses apportées au droit interne, la Loi 89 rejoint tacitement les règles de conflit du droit international privé. Elle amènera les tribunaux à y élaborer de nouvelles solutions aux problèmes de droit de la famille, notamment ceux que l’auteur étudie en première partie, les estimant plus immédiats. Et puisqu’un nouveau droit constitutionnel canadien prend forme, retournant aux provinces la juridiction en matière de mariage et de divorce, suit, dans un second temps, l’analyse de certains aménagements déjà proposés. Quelle sera la reconnaissance dans une province, d’un divorce, d’une ordonnance de pension alimentaire ou de garde d’un enfant, prononcés à l’extérieur de cette province ou du pays ? Des ententes et conventions internationales peuvent inspirer aux canadiens des solutions respectueuses tant des règles de conflit que de l’originalité des deux systèmes juridiques en présence.
