Abstract
Le Code civil du Bas-Canada contient plusieurs dispositions de droit maritime. Ces règles se sont formées sur une base d’emprunt. Ainsi, la province de Québec, d’abord colonie française puis colonie anglaise a reçu de ses métropoles les éléments qui furent retenus par les Codificateurs dans la rédaction de ces dispositions en 1866. L’auteur analyse donc le droit maritime et les juridictions chargées de l’appliquer sous le régime français puis sous le régime anglais. L’analyse est historique. Par ailleurs, le Code civil a été adopté par un corps législatif souverain sur un plan local. En 1866, la seule limite qui s’imposait aux Codificateurs découlait du statut colonial. Comment cette limite a-t-elle pu influer sur l’insertion dans le Code de dispositions maritimes ?
